These terms govern your use of https://officialmiso.com and any purchase you make from us. By using the site or placing an order you agree to them. Please read them alongside our Privacy Policy, Cookie Policy, Shipping Policy, Refund Policy and Product Disclaimer, which all form part of these terms.

1. Who we are

This site is operated by Miso. In these terms "we", "us" and "our" mean Miso. "You" means the person using the site or placing an order. You can reach us at any time at info@officialmiso.com.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to order from us. By ordering you confirm that you are. We sell to consumers in the United Kingdom only.

3. How a contract is formed

Everything on the site is an invitation to buy, not a binding offer. When you place an order you are making an offer to buy. Our order confirmation email is an acknowledgement, not an acceptance. A contract is formed only when we send you the shipping confirmation email.

We may decline an order, for example if the item is out of stock, if we have priced or described something incorrectly, if we cannot deliver to your address, or if we suspect fraud. If we decline after you have paid, we refund you in full.

4. Prices and payment

Prices are shown in pounds sterling. The price shown at checkout is the total amount you pay. Shipping is free on all UK orders and nothing further is added at any stage.

We accept payment through Shopify Payments, including Visa, Mastercard, American Express, Apple Pay, Google Pay and Shop Pay. Payment is taken when you place your order.

We may change prices at any time, but changes do not affect orders we have already accepted. Occasionally an item may be mispriced. If the correct price is higher than the price shown, we will contact you before dispatch and you can confirm at the correct price or cancel for a full refund. We will never charge you more without asking first.

5. Promotions and discount codes

Offers such as buy one get one free run for a stated period, apply only while stocks last, and cannot be combined with other offers unless we say so. We may withdraw or change a promotion at any time, but not for orders already placed. Discount codes are for personal use and may not be resold.

6. Product descriptions and images

We describe our products as accurately as we can. Photographs are illustrative. Colours can look different between screens, packaging may be updated by the manufacturer, and formulations may be reformulated over time. Always read the ingredients on the packaging you receive, particularly if you have allergies.

7. Acceptable use

You agree not to:

  • Use the site for any unlawful or fraudulent purpose
  • Attempt to gain unauthorised access to the site or its systems
  • Introduce malware or attempt to disrupt the site
  • Scrape, copy or republish our content, images or copy without permission
  • Resell our products commercially without our written agreement
  • Post reviews or messages that are abusive, defamatory, dishonest or infringe someone else's rights

We may suspend or refuse service to anyone who breaches this section.

8. Intellectual property

All content on the site, including the Miso name, logo, text, photography, video and page design, belongs to us or our licensors and is protected by copyright and trade mark law. You may view and print pages for your own personal use. Any other use requires our written permission.

9. Reviews and content you submit

If you submit a review, photo or comment, you confirm it is your own honest opinion and experience, and you grant us a non exclusive, royalty free licence to use, display and reproduce it in our marketing. You can ask us to remove your content at any time by emailing us. We may remove content that is abusive, false or unlawful.

10. Availability of the site

We try to keep the site available at all times but we do not guarantee it. We may suspend, withdraw or restrict all or part of the site for business or operational reasons, and we will give notice where we reasonably can.

11. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, or for any other liability that cannot lawfully be excluded.

Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not supply our products for business use, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Where we are liable, and to the extent the law allows, our total liability in connection with an order will not exceed the amount you paid for that order.

12. Events outside our control

We are not liable for delays or failures caused by events beyond our reasonable control, including strikes, carrier failures, extreme weather, fire, flood, epidemic, war, civil unrest, or failure of public or private telecommunications networks. If such an event occurs we will contact you and either extend delivery timescales or, if the delay is substantial, allow you to cancel for a full refund.

13. Complaints and disputes

If something has gone wrong, email info@officialmiso.com first. We aim to acknowledge within 2 business days and resolve within 14 days. Most issues are settled quickly and informally.

14. Governing law

These terms are governed by the laws of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts. This does not affect your rights as a consumer.

15. General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not insist on something immediately, that does not stop us doing so later. We may update these terms, and the version in force is the one published on the site when you place your order.
